TERMS AND CONDITIONS OF SALE

1. Identification of the seller

2. Purpose and scope

These terms and conditions of sale govern all sales concluded on the website www.smaistasor.store between the seller and any customer, whether a business or a consumer. Any order implies full and complete acceptance of these terms, which the customer declares having read before validating their purchase. The seller reserves the right to amend them at any time; the applicable terms are those in force on the day of the order.

3. Products

The products offered are described and presented with the greatest possible accuracy. Photographs and illustrations are indicative only and do not form part of the contract. Offers are valid while stocks last.

4. Prices

Prices are shown in euros, inclusive of all taxes. Delivery is free: the price displayed is the only amount owed to the seller, whatever the destination. The total amount of the order is brought to the customer's attention before it is definitively validated.

The seller reserves the right to amend its prices at any time. Products are invoiced on the basis of the rates in force at the time the order is recorded.

5. Orders

Orders are placed exclusively online, on the website. The customer selects their products, checks the details of their order, corrects any errors where applicable, then confirms by accepting these terms. Confirmation constitutes an electronic signature and acceptance of the operations carried out.

The sale is definitively concluded upon receipt of payment in full. A confirmation e-mail summarising the order is sent to the customer.

The seller reserves the right to refuse or cancel any order that is abnormal in character, made in bad faith, or placed by a customer with whom a payment dispute is ongoing.

6. Payment

The accepted means of payment are bank card, PayPal and bank transfer. Payment is due immediately on ordering. The order is dispatched only after payment has actually been collected.

Bank card transactions are secure: payment data is transmitted in encrypted form to the payment institution and is never stored by the seller.

7. Delivery

Delivery charges are free: the price displayed is the only amount owed to the seller, whatever the destination. Any customs duties and import taxes due in the country of destination are not included in this amount and remain payable by the recipient, on the conditions detailed in the shipping policy.

Products are delivered to the address given by the customer when ordering. The seller delivers to mainland France, the European Union and internationally. Orders are shipped via the company OMGO.

Preparation time: 24 to 72 working hours.
Delivery time: 2 to 15 working days from dispatch, depending on the destination.

The seller undertakes to deliver no later than thirty (30) days after the contract is concluded. If this period is exceeded, the customer may require the seller to deliver within a reasonable additional period and then, failing performance, terminate the contract by registered letter or in writing on another durable medium. The sums paid are then refunded to the customer within fourteen (14) days following termination.

In accordance with article L221-15 of the French Consumer Code, the seller is liable as of right towards the consumer for the proper performance of the order, whether it is performed by the seller itself or by a carrier. The seller may be released from liability only if the failure to perform is attributable to the consumer, to a third party unconnected with the supply of the services, or to a case of force majeure.

Risk of loss or damage transfers at the moment when the customer, or a third party designated by the customer, takes physical possession of the product.

The customer is invited to check the condition of the parcel on receipt and to report any anomaly to the seller within seven (7) days.

8. Right of withdrawal (consumer customers)

In accordance with article L221-18 of the French Consumer Code, a consumer customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to give reasons for their decision or to bear any penalty.

To exercise this right, the customer notifies the seller of their decision by an unambiguous statement sent to smaista@smaistasor.store, or by using the model form set out in article 13 hereof.

The product must be returned in its original condition, complete and unused, within fourteen (14) days following notification. The direct costs of return are payable by the customer, unless the product is defective or not as described.

The refund covers the price of the product as well as the standard delivery charges initially paid. If the customer had chosen a delivery method more expensive than the standard offer, only the amount of the latter is refunded. The refund is made no later than fourteen (14) days after the seller has been informed of the decision to withdraw; it may be deferred until the product is recovered or until the customer provides proof that it has been dispatched.

The customer may be held liable for any depreciation of the product resulting from handling other than that necessary to establish its nature and characteristics.

9. Legal guarantees

The seller is liable for lack of conformity of the goods with the contract, on the conditions of articles L217-3 et seq. of the French Consumer Code, and for latent defects, on the conditions of articles 1641 et seq. of the French Civil Code.

Legal guarantee of conformity: the customer has a period of two (2) years from delivery of the goods in which to bring an action. The customer may choose between repair and replacement, subject to the cost conditions laid down by law. The customer is exempt from providing proof of the existence of the defect during the twenty-four (24) months following delivery, the goods being new. Bringing the goods into conformity is carried out at no cost to the customer.

Guarantee against latent defects: the customer may bring an action within a period of two (2) years from the discovery of the defect, and obtain either rescission of the sale with reimbursement of the price, or a reduction in the price.

These guarantees apply independently of the right of withdrawal. They cover neither normal wear and tear, nor damage resulting from abnormal use, negligence or failure to comply with the instructions for use.

To invoke a guarantee, the customer writes to smaista@smaistasor.store.

10. After-sales service and complaints

Any complaint may be sent to smaista@smaistasor.store. The seller undertakes to acknowledge receipt of it and to reply to it within a period of five (5) working days.

11. Personal data

The data collected in connection with an order is necessary for its processing and is never transferred to third parties for commercial purposes. In accordance with the General Data Protection Regulation, the customer has a right of access, rectification, erasure, restriction, objection and portability, which they exercise at the address smaista@smaistasor.store. The full arrangements are set out in the website's privacy policy.

12. Applicable law, mediation and disputes

These terms and conditions of sale are governed by French law.

In the event of difficulty, the customer is invited to contact the seller first in order to seek an amicable solution. This step is optional and does not deprive the customer of any remedy.

In accordance with article L612-1 of the French Consumer Code, a consumer customer may refer the matter free of charge to a consumer ombudsman with a view to the amicable resolution of the dispute. 

The competent ombudsman is:

Failing an amicable resolution, the dispute may be brought before the competent courts.

13. Model withdrawal form

A customer wishing to withdraw may copy out and complete the following form, then send it to smaista@smaistasor.store:
